Proclamation 11038 authorizes temporary duty-free entry of Moroccan phosphate fertilizer

Proclamation 11038 of June 29, 2026 declares an emergency under section 318 of the Tariff Act of 1930 over fertilizer supply. It directs the Secretaries of the Treasury and Commerce to permit phosphate fertilizers of Morocco to be imported free of the collection of duties and estimated duty deposits under 19 U.S.C. 1671, 1675 and 1677j (countervailing duty and related provisions). The relief lasts until the earlier of 8 months after the proclamation date or the end of the emergency, and applies under regulations and conditions the Secretaries prescribe. The Secretaries may also extend deadlines for acts related to these imports during that period.
